Bike Vantage Customer Personal Data Protection Policy

 

1. Our customer's personal data, collected within the framework of established commercial transactions, namely when executing contracts for the purchase and sale of goods or provision of services, including deliveries, assemblies and repairs, including under warranty, will be considered and processed for effective performance of the contract, its conditions, invoicing, collection, guarantees and other acts of contractual performance, including accessories or related, treatment that seems necessary for the full performance of the purchase and sale contract or the provision of adjacent services, to compliance with the legal obligations imposed on Bike Vantage, in pursuit of Bike Vantage's legitimate interests and, also, for all legal purposes for which the customer's unequivocal consent was obtained. 

2. Bike Vantage will always process personal data to the extent necessary for the collection of debts resulting from commercial transactions carried out, the purchase and sale of goods or the provision of services, based either on the execution of concluded contracts or on in your legitimate interest in asserting your right to this charge. 

3. Bike Vantage may also use the customer's personal data to carry out quality audits of its products and services provided or satisfaction surveys, for marketing, advertising and sales purposes, for customer management, for accounting and auditing purposes , for the purposes of litigation, the prevention and detection of crimes, and the fulfillment of its legal obligations.

5. The processing of data for marketing or advertising purposes will always and obligatorily take into account the scope and content of the prior consent expressed by the customer. The customer's consent for their data to be processed for the aforementioned purposes must consist of a free, specific, informed, explicit and unequivocal expression of will, carried out through a written, oral statement or other positive act. The customer may, at any time, oppose the processing of their data for marketing and advertising purposes, Bike Vantage guarantees that the customer may withdraw their consent at any time and by any means._cc781905-5cde-3194- bb3b-136bad5cf58d_

6. Bike Vantage is a trademark belonging toBikevantage, Unipessoal, Lda, Sociedad Unipessoal por Quotas, Share Capital: 5000€ with Registration at the Commercial Registry Office NIPC: 516386441, headquartered at Rua Alto de Sampaio, Lote 55, Ala A, 1ºEsq 3670-270 Vouzela, is the entity responsible for the treatment of the referred personal data. 

7. The customer has the right to request access to his personal data, rectification of those that are inaccurate or incomplete, erasure of personal data, total or partial limitation of the processing of personal data, he also has the right to oppose the processing and the right to portability of personal data in a structured, commonly used and machine-readable format. To exercise said rights and for any question related to the protection of personal data, the customer may contact Bike Vantage, through the following means:

8. Bike Vantage will proceed as requested by the customer and in the shortest period of time and never in a period longer than 30 days after receipt by Bike Vantage of the request made by the customer through the means indicated above._cc781905-5cde-3194 -bb3b-136bad5cf58d_

9. Bike Vantage may transmit the customer's personal data to third parties, whether partners or suppliers, contracted by Bike Vantage for the effective fulfillment of the contract, namely transport companies, assembly services and for the purpose of executing guarantees.  

10. The customer's personal data will be kept for different periods of time, depending on the purpose for which they are intended, namely during the term of the contract and guarantees, plus the deadlines for billing and claims, prescription and expiry of rights associates, and may also be kept for the fulfillment of legal obligations, for the purposes of investigation and legal actions of a criminal nature and for statistical purposes, and for the latter purpose, they must be anonymised. 

11. If, at any time, the customer considers that his rights have been violated under the terms of the applicable law on data protection, he may, without prejudice to complaining to Bike Vantage, present a complaint to the competent control authority, in the event of Portugal, the National Data Protection Commission. 

12. Bike Vantage is concerned with the treatment given to its client's personal data, so it will always adopt all the measures that are appropriate, necessary and essential for the defense and protection of said personal data and for the fulfillment of the provisions of the General Data Protection Regulation, approved by European Regulation No. 2016/679 of the European Parliament and of the Council, of April 27. 

13. The mentioned General Data Protection Regulation comes into force on May 25, 2018, producing its effects from that date.

RETURNS POLICY

Bike Vantage items have a 2-year warranty, starting from the date the invoice is issued. 
To claim the product warranty, you must contact us via email geral@bikevantage.pt or via the online form.

Bike Vantage reserves the right to make a prior assessment of the damage or breakdown, at our facilities or by alternative means of assessment. The item can be sent to our address indicated on the invoice, with shipping costs borne by the customer. This amount will always be refunded if it turns out to be a defect covered by the warranty. 

In the first 14 days after purchase and if you are not completely satisfied with your purchase, you will be refunded, presenting the purchase document and provided that the item has not been assembled or used and is properly packed in the original packaging. In this situation, the amount will be credited to the customer's account, considering that the costs inherent in transport or collection will always be the responsibility of the customer. 
 

When the item has a cost associated with assembly and the customer does not contract this service, the warranty may not cover damages that are found to be associated with poor assembly.
